Qwazz is a mobile social gaming service developed and operated by Qwazz Technologies GmbH, Germany (”Qwazz”). Qwazz consists mainly of software that you have downloaded or are about to download, software that you have embedded or which is or was embedded by Qwazz on a web site or you are about to embed (”Qwazz Games”), applications created by Qwazz and are available through social networking sites (”SNS Apps”) or the Apple AppStore, software running on Qwazz’s servers, (”Qwazz Software”), content, related documentation, information on the Qwazz domain, and information made available by users to each other through the Qwazz Software (the “Service”).

We very much think about securing your privacy.

This Policy describes how we collect, use and, in certain circumstances, share your personal information. We ask you to read this policy with care.

By using the Service, you consent to the collection and use of your personal information as outlined in this Privacy Policy. From time to time this policy might be updated by us. In that case we will post a notice on the website www.qwazz.com. So please visit this page periodically to see if any changes have occurred.

Data to be collected

Qwazz gives you a number of options regarding what information you will give us:

If you identify yourself on a Qwazz site or within an application, you may identify yourself by using a Qwazz account. You may also identify yourself through a social network account. In that case Qwazz may receive additional information about your profile. Your profile including any information will be registered.

Other than profile data provided at your discretion, we don’t generally collect any “Personally Identifying Information” about our users. We will collect and record the information you have provided. The service may offer you the opportunity to submit also other information about yourself (such as gender, age, hobbies or you might use “messages” etc.). In addition to information about yourself, you may choose to share information about yourself via messages to other users. Any information you share with other users is at your own risk.

We may be able to collect that information from any social networking systems if you use Qwazz or Qwazz related SNS Apps (in accordance with the terms of use of those systems), this then would also be covered by this Privacy Policy.

We collect and maintain on secure servers the information associated with messages, which you write to other users including email addresses and content. This also applies for those messages you use to invite new members.

Our service, apps and sites may be linked to other websites. Qwazz is not responsible for the privacy practices of services offered by those services, apps and websites. Therefore we encourage our users to be always aware when they leave our service to read the privacy statements of other sites that collect personal information. This Privacy Policy applies solely to information collected by Qwazz.

In order to make certain internal reports and make recommendations to improve our offerings, we collect aggregate information about the way this service is used. This includes all information about users accessing the Qwazz site or playing Qwazz games or using Qwazz related SNS Apps on other sites. We collect information such as internet protocol addresses, referring / exit pages, browser language and browser type, URLs, other browser history, domain names, platform type, number of clicks,landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, and the date and time (”Activity Information”).

By using the Service, you consent to our collecting and retaining all the above-described information in anonymous form as long as Qwazz sees fit.

Use of data

To notify you of new product releases, we may only use email address, your name, and other information on our system, service notifications, and to collect your feedback and input. Those emails will contain links for preference management and where appropriate, unsubscribe links should you decide you do not want to receive further emails. Your personally information is never rented or sold to any third party by us.

If required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to avoid liability, to comply with legal process, such as a search warrant, subpoena, statute, or court order, or to protect our rights and property, or that of our affiliates or the public, we may disclose, access or preserve any information we may have about you and the contents of your account. Qwazz is not required to question or contest the validity of any governmental request that Qwazz receives.

Qwazz may maintain copies of your Content indefinitely, or delete certain Content in whole or in part for any or no reason.

In order to operate, maintain and manage the Service, we also use non-personally identifiable information and certain technical information about your computer and your access of the Service (including your internet protocol address). Only in order to provide the service, resolve service problems or correct errors in the Service, Qwazz may disclose information about you to its partners. Due to our contractual obligations with third parties and the need to share information to manage, deliver, host and support the Service, we cannot offer you with an opt-out opportunity of sharing information with these third parties.

Please notice that if you send any messages or post notes containing personal information, that information may be collected and used by others.

Qwazz and Qwazz employees as well as each of Qwazz contractors may view the Content posted or send by you to the service to provide the Service and otherwise perform the tasks set forth in this Privacy Policy.

Security

Because email and instant messaging are not recognized as secure communications, we request that you not send private information to us by email or instant messaging services. Qwazz takes appropriate precautions to protect our users’ information. Your account information is located on a secured server behind a firewall. Termination of your account

You can terminate your account at any time. Your profile and other personal information will then be removed from view. Qwazz, however, may (but is not obligated to) keep the information collected about you that is on its system following your termination. Please contact Qwazz to terminate your account or for any other questions about your personal information.

Transfer of Information

In the event of a merger or transfer of ownership of Qwazz or the acquisition of substantially all the assets of Qwazz related to the business which collected the information we reserve the right to transfer your personal information. In that case Qwazz will notify users who have provided email addresses when information about those users is transferred and becomes subject to a different privacy policy. Information about this case would be published on www.qwazz.com.

Information of other persons

You might wish to send us other person’s email address so that those persons may be invited to join. In order to comply with legal process, we may disclose such information if required to do so.Any Information connected to your account regarding the data from your adress book will be collected by Qwazz in order to provide the service. The only purpose is to give you the opportunity to invite those contacts to the service. The data will not be used otherwise.

Users under the age of 13

Qwazz is a service only for users over the age of 13. Qwazz does not knowingly collect, retain or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not register at Qwazz or send any information about yourself to us related to a registration process. No one under age 13 may provide any personal information to Qwazz or on Qwazz. In the event that we learn that we have collected personal information from a child under age 13 we will delete that information as quickly as possible. User under the age of 18

We recommend that minors over the age of 18 ask their parents for permission before sending any information about themselves to anyone over the Internet.

Cookies

When you access the Qwazz site or application the Service sends “cookies” to your computer. To improve the service cookies might be used. A cookie is a small text file recorded on your hard drive that identifies you as a unique user and contains certain information about your particular login session and/or your use of the Service.

For California residents: your California privacy rights

Under California law, California Residents who have an established business relationship with Qwazz or one of its subsidiaries may choose to opt out of Qwazz disclosure of personal information about them to third parties for direct marketing purposes. As detailed above, our policy is not to disclose personal information collected online to a third party for direct marketing purposes without your approval.
